Terms of Service
Effective July 28, 2026
You keep the rights to what you upload and what you make. You are responsible for having permission to use what you upload, and for not using this tool to make illegal or abusive content. Credits are consumed when a generation is dispatched, whatever the result. The service is provided as-is.
1. The agreement
These terms are between you and Qualia LP, 2967 Dundas Street West, Suite 207d, Toronto, Ontario M6P1Z2, Canada("we", "us"). They cover justpictur.ing, the app at app.justpictur.ing, the justshar.ing permalink pages and our API. By creating an account or using the service you agree to them. If you do not agree, do not use the service.
2. Who may use it
You must be at least 18 years old and able to enter a binding contract. If you are using it for an organisation, you confirm you are authorised to bind that organisation. You may not use it if we have previously terminated your account.
3. Your account
Keep your sign-in details and any personal access tokens you create to yourself; anything done with them is treated as done by you. Tell us at [email protected] if you think someone else has access. You can delete your account at any time from Settings → Profile.
4. Acceptable use
You may not use justpictur.ing to create, upload, store or share:
- Sexual content involving minors, or any depiction of a minor in a sexualised way. This is reported to the authorities and the account is terminated without notice.
- Intimate or sexual imagery of a real, identifiable person made or shared without that person's consent.
- Content that impersonates a real person or organisation in order to deceive — including synthetic depictions of real people presented as genuine, forged documents, and fake endorsements.
- Material that infringes someone else's copyright, trademark, likeness or other rights, or that you do not have permission to upload.
- Content that harasses, threatens, or incites violence against a person or group, or that promotes self-harm.
- Content that promotes terrorism or violent extremism, or that gives instructions for weapons, explosives or other serious harm.
- Anything illegal where you are, or anything designed to defraud.
You also may not:
- Probe, scrape or overload the service, evade rate limits or credit accounting, or use automated means beyond our documented API.
- Resell the service or pass it off as your own product.
- Use outputs to train a competing generative model, or to build a derivative dataset from the service.
Reporting. Anyone — you do not need an account — can report content on justpictur.ing or justshar.ing by emailing [email protected] with the link and what is wrong with it. We review reports, and we may remove content, disable a share link or terminate an account. We will tell you if we act on something you posted, unless the law stops us. If you think we got it wrong, reply and a person will look again.
5. Who owns what
Your uploads stay yours. You give us the licence we need to host, process, transmit and display them so the service can work — to send them to a model provider to produce your result, to store them, to show them back to you, and to serve them to anyone you share a link with. That licence ends when you delete the content, except for copies already made by someone you shared with.
Your outputs are yours, to the extent they can be owned at all. Generative outputs may not be protectable by copyright in your country, and similar prompts can produce similar results for other people, so we do not promise your output is unique or exclusive to you. You are responsible for checking that using an output is lawful where you use it.
Model providers set their own terms for outputs produced with their models; those apply on top of these.
The service stays ours. The software, brand and design are ours; nothing here transfers them to you.
6. Plans, credits and payment
Generation costs credits. A credit is consumed when work is dispatched to a model provider, so a generation that fails or that you do not like has still been paid for — we refund credits only where a failure was ours. Credits have no cash value, cannot be transferred, and are not refundable except where the law requires it.
Paid plans renew automatically until cancelled from Settings → Billing. Cancelling stops the next renewal; it does not refund the period you are in. Prices exclude any taxes we must charge. Our merchant of record handles payment and issues your receipt.
If you are a consumer in the EU or the UK: digital content supplied immediately normally ends your 14-day right to withdraw. By starting a subscription and generating something, you ask us to begin supplying immediately and accept that you lose that right once we have. Your other statutory rights are unaffected.
7. Availability and changes
We may change, suspend or stop features. If we make a change that materially reduces what a paid plan gets, we will tell you before it takes effect and you may cancel. We do not promise any level of availability.
8. Ending it
You can stop at any time by deleting your account. We may suspend or terminate an account that breaks section 4, that creates legal risk for us or another user, or that has been inactive for a long time — with notice where we reasonably can, and immediately where we cannot. On termination your content is deleted as described in our Privacy Policy.
9. Disclaimer
The service is provided "as is". To the fullest extent the law allows, we disclaim all warranties, including fitness for a particular purpose and non-infringement. Generative models produce inaccurate, biased and unexpected results; do not rely on an output as fact, and check anything you publish.
10. Liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, lost revenue or lost data. Our total liability for any claim is limited to what you paid us in the twelve months before the claim, or one hundred Canadian dollars, whichever is greater. Nothing here limits liability that cannot be limited by law, including for fraud, death or personal injury caused by negligence — and if you are a consumer, nothing here removes your mandatory statutory rights.
11. Indemnity
If someone brings a claim against us because of what you uploaded, generated or shared, or because you broke these terms, you will cover our reasonable losses and legal costs.
12. Governing law
These terms are governed by the Province of Ontario and the federal laws of Canada applicable in it, and the courts of Ontario have jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory law of your own country or of the right to bring proceedings there.
13. The rest
If a clause is unenforceable the rest stands. Not enforcing something once does not waive it. You may not assign these terms; we may assign them to a successor of the business. These terms and the Privacy Policy are the whole agreement between us. We may update them — the effective date at the top changes, and for material changes we will tell you before they take effect.
